Insurance Coverage and Litigation: The primary elements of the insurance contract are the duty of the insurer to defend the insured and the duty of the insurer to indemnify the insured in the case of a covered event. There are some cases, however, when these elements are not easily recognizable. We have done extensive (and often times groundbreaking) work in this area of the law.
Tort Litigation: Torts are civil wrongs that cause harm or personal injury to another party. Torts can be intentional, negligent, or strict liability and enter into nearly every area of human interaction. Will, Estate, and Trust Litigation: We offer comprehensive estate planning guidance, including handling contested wills and trusts and probate litigation. In fact, we often assist other attorneys who have may have drafted a will or trust, but have limited knowledge of the estate litigation process.
Eminent Domain Litigation: Eminent domain is the process by which private property is condemned by a government entity to be purchased or used for the public good. The eminent domain process is complicated, and public entities do not always offer just compensation to private land owners. We have been involved in the prosecution and defense of numerous eminent domain actions, and we have extensive knowledge of the process.
Appellate Law and Practice: A party that is not satisfied with a court ruling has the option to appeal to a higher court. Appeals are difficult, however, because you must meet a higher bar for an appellate court to overturn a lower court ruling. We have handled numerous appeals over the years, and we understand what it takes to secure favorable outcomes for our clients.
Alternative Dispute Resolution (ADR): Litigation is not always the best way to handle a legal dispute. Taking a case to trial can be costly, lengthy, and often counter-productive. Two popular forms of alternative dispute resolution are mediation and arbitration. We work closely with our clients to help determine the best legal avenue to resolve the case successfully.
